I refer to your further email of 9 June 2025 about the Tribunal’s handling of National Disability Insurance Scheme matters, and in particular the issue of “the Tribunal, via individual members, forming its own view of competing medical theories”. I have advised both the President and the Chief Executive Officer and Principal Registrar of your further correspondence and have been asked to respond on behalf of the Tribunal.
As noted in my letter of 17 April 2025, it is not appropriate for me to comment on decisions made by Tribunal members. Tribunal members are independent decision makers who conduct merits review of administrative decisions. They consider afresh the facts, the law and policy relating to administrative decisions, and decide what is the correct or preferrable decision based on the material before them. Accordingly, there is nothing further I can add to my response of 17 April 2025 regarding this issue.
In closing, I note that if a person is dissatisfied with a decision of the Tribunal, it may be open for them to apply to a court or to the Guidance and Appeals Panel.
