cruel NDIS policy targets the most autistic and vulnerable NDIS participants

NDIS policy (AAT Case Management Guide Applied Behavioural Analysis (ABA) - see below) fails some of the youngest and most severely autistic NDIS participants. Clinicians advise that some children with severe/profound or classic autism need intensive early intervention for their autism. NDIS policy (see below) says funding for the required early intervention depends on families winning a case against the government in the Administrative Appeals Tribunal (AAT).

Attorney-general disavows responsibility for the recently-created Administrative Review Tribunal (ART)

Recent communication with the Attorney-General shows major disinterest in whether the Administrative Review Tribunal (ART) that the government created in 2024 works effectively. 

A4's major concerns with the operation of the ART's NDIS division include:

ART allows arbitrary delay in making its decisions

The email chain below shows Bob Buckley's email discussion with the ART about delays in Members making decisions following a final hearing in NDIS matters. The ART says there is no time constraint. 

The heads of the ART and the NDIS division have not responded. The Attorney-General is also uninterested. 

There is an old legal maxim that says "Justice delayed is justice denied". The principle of timely decisions was established in the Magna Carta, the foundation of our legal system. 

Please EAC, don't take side in autism issues

Autism Aspergers Advocacy Australia (A4) is disappointed and alarmed that EAC took a side on the issue of ABA (presumably meaning EIBI), a therapeutic application of Applied Behaviour Analysis (ABA), through it's recent publication of anti-ABA articles authored by Ms Sarah Langston. In particular, we refer to https://everyaustraliancounts.com.au/thriving-kids-position-statement/ that says misleadingly:

Please find attached a letter describing concerns from the Disability Representative Organisation (DRO) for autistic Australians, the national group that represents and advocates for the full autistic spectrum including many autistic Australians diagnosed formally with severe and/or profound disability many of whom cannot speak for themselves and whose interests are not represented by autistic self-advocates (who mainly represent their own part of the autism spectrum).

Bob Buckley lodged a formal complaint to The Nightly about their publication of an article MARK RILEY: Drastic changes coming to NDIS as unofficial rorting by parents is increasing cost to taxpayers 18/4/2026 that claims:

The only reasonable assumption is that parents have been gaming the system, exaggerating their children’s symptoms in order to secure packages.
