Recent communication with the Attorney-General shows major disinterest in whether the Administrative Review Tribunal (ART) that the government created in 2024 works effectively. 

A4's major concerns with the operation of the ART's NDIS division include:

  1. excessive delays in some Tribunal decisions (see https://a4.org.au/node/2789),
  2. a dysfunctional recusal process, and
  3. unevidenced opinions from Respondent's IMEs.

The Attorney-General says the Tribunal is "independent" and denies any responsibility for its operation. 

The second recusal response claims to provide a link to sure obligations is available through the Tribunal’s Member Code of Conduct - but the link did not work when A4 tried it. 

The response talked about "the process for providing feedback or making a complaint". Previously, A4 tried the ART's complaints process ... and found it dysfunctional. The process dismissed all public concern over many issues, instead excusing/justifying all aspects of the Tribunal's operation. A4 observes that the Tribunal refuses to learn from public feedback.
